The Energy Commission (Local Content and Local Participation) (Electricity Supply Industry) Regulations, 2017, (L.I. 2354) was passed by the Parliament of Ghana into law on 22nd December 2017.
Regulation 28 of L.I.2354 requires entities who seek to or are engaged in any activity within the Electricity Supply Industry (ESI) to submit their Local Content and Local Participation plans, to the Local Content Committee.
The L.I. in Regulation 82 defines a service provider to include an operator, contractor, subcontractor, or any other person performing paid services for a person licensed to provide a service under the Energy Commission Act, 1997 (Act 541) or the Renewable Energy Act, 2011 (Act 832).
Such entities have been categorized by the Commission as category B service providers. They include but are not limited to entities that provide Legal, Financial, Engineering & Maintenance, Insurance, Fuel, Lubricant & Water, and Allied (Transport, Vehicle hire, vehicle maintenance & repairs, catering, and janitorial services) services.
The Local Content Committee has developed templates for the submission of the required information as stated above. The Committee, if satisfied with the submissions, shall issue a Certificate of Authorization to the service provider demonstrating compliance of the Service provider/manufacturer with the local content and local participation requirements under the Regulation. Note that only entities who possess a valid Certificate of Authorisation are permitted to provide services for licensed entities in the ESI.
