APPOINTMENT OF ELECTRICITY COMPANY OF GHANA AS INTERIM OPERATOR TO TAKE CHARGE OF MANAGEMENT AND OPERATION OF ELECTRICITY SALES UNDER LICENCE NO: EC/ESL/02-19-001 ISSUED TO POWER DISTRIBUTION SERVICES GHANA LIMITED
1. IN ACCORDANCE WITH CLAUSE 27 OF THE ELECTRICITY SALE LICENCE (LICENCE NO: EC/ESL/02-19-001) ISSUED TO THE POWER DISTRIBUTION SERVICES GHANA LIMITED (PDS), THE ENERGY COMMISSION HEREBY APPOINTS THE ELECTRICITY COMPANY OF GHANA (ECG) AS THE INTERIM OPERATOR OF THE ELECTRICITY RETAIL SALE FUNCTIONS IN THE SOUTHERN DISTRIBUTION ZONE UNDER LICENCE NUMBER EC/ESL/02-19-001
2. The decision of the Commission is based on the validity of the said licence becoming impaired as a result of the following events:
- The Demand Guarantees submitted by PDS to ECG having been disavowed by the issuer and declared null and void;
- The consequent impairment of the Lease and Assignment Agreement (LAA) between ECG and PDS; and
- The decision by ECG to suspend the provisions of rights and obligations defined under the LAA pending determination of all consequential matters arising out of the above.
3. In consequence of the above, PDS is to facilitate and provide ECG with the needed access to all billing systems, metering operations, payment accounts, etc. required for the effective operation of the retail sales licence.
